What Is a No-Bail Hold in California?

What "no bail" means on a California booking record and how to clear it.

When a California jail record shows "No Bail" instead of a dollar amount, the defendant cannot be bonded out at the schedule rate. They must wait for arraignment or a bail review hearing.

    Why bail gets withheld

Most common reasons: probation/parole violation, outstanding warrants from another jurisdiction, ICE detainer, capital crime charges, or a judge's order on dangerousness.

    Probation/PRCS holds

If the defendant is on probation, post-release supervision (PRCS), or parole, the supervising agency can place a no-bail hold. Clearing requires a probation hearing.

    Out-of-state holds

Another state has issued a warrant. The hold lifts when the other jurisdiction either extradites or declines.

    Capital cases

PC 187 murder and certain other charges are automatically no-bail until a judge reviews evidence at a bail hearing.

    How to clear it

A bail review hearing or motion to set bail must be filed by the defense attorney. Some holds clear in days, others in weeks.

    Call when bail gets set

Once the hold clears and a bail amount is set, call (909) 406-6909 immediately. Bonds can be posted the same hour.
