What Is a 1275 Hold in California Bail?

PC 1275 holds require proof that bail money came from a legitimate source. Here's how to clear them.

A PC 1275 hold is a court order requiring the defendant or co-signer to prove the bail money came from a legitimate, traceable source. It's most common in drug cases, large-dollar fraud cases, and cases involving suspected criminal proceeds.

    When 1275 holds are triggered

The DA or judge can request one on any case. Most common triggers: drug trafficking, fraud over $25,000, organized crime allegations, or any case where bail seems disproportionate to legitimate income.

    What you have to prove

The source of the funds (paystubs, bank statements, tax returns), the relationship of the source to the defendant, and that the money isn't proceeds of the alleged crime.

    How long it takes

A 1275 hearing must be set. Most courts schedule within 5–10 days. Without a hearing, no bail can be posted.
