What Happens If the Defendant Skips Bail?

180 days, recovery agents, and the financial fallout for the co-signer.

If the defendant fails to appear and can't be found, the bond goes into forfeiture. Under California Penal Code §1305, the bondsman has 180 days to bring the defendant back.

    Recovery efforts

Bondsmen use licensed fugitive recovery agents. Most defendants are found within 90 days.

    If the defendant is recovered

The bond is exonerated. The co-signer pays any recovery costs — usually a few thousand dollars.

    If the defendant isn't found

The full bail amount is forfeited. The co-signer is liable for the entire bail amount, plus any collateral pledged is seized.
