Non-citizens face two parallel systems: state criminal bail and federal immigration custody. Posting one doesn't release from the other.
Check for ICE hold
Before posting state bail, ask the jail whether there's an immigration detainer. If there is, paying state bail doesn't get the defendant out — ICE takes custody.
Immigration bond
If transferred to ICE custody, a separate immigration bond may be available — typically $1,500 minimum, posted at the ICE field office or designated bondsman.
Coordinate with immigration counsel
Always involve an immigration attorney before posting state bail for a non-citizen. Wrong moves can trigger removal proceedings.
