Failure to Appear (FTA) Warrants in California

How FTA warrants work, and the fastest way to clear one.

An FTA — Failure to Appear — is a bench warrant issued when a defendant misses a court date. It's both a new charge (PC 1320 / VC 40508) and a warrant for the original case.

    Misdemeanor FTA

Charged as a misdemeanor, max one year jail and/or $1,000 fine, on top of original case consequences.

    Felony FTA

If the original case was a felony, FTA is also a felony — up to three years in state prison.

    Clearing it

Voluntary surrender with an attorney is the standard play. Most judges restore bail and the case continues.
