Juvenile Arrests in California: Bail and Release

Juvenile court is different — here's how release works for under-18 defendants.

California juvenile court doesn't use cash bail. Release decisions are made by probation officers and juvenile court judges.

    Detention or release

After a juvenile arrest, the probation officer decides whether to detain or release to parents. Most non-violent first-time juveniles are released.

    Detention hearing

If detained, a detention hearing must be held within 48 hours. Parents and counsel should attend.

    If charged as an adult

Juveniles 16+ charged with serious violent crimes can be tried as adults under PC 707(b). In that case adult bail rules apply.
