Domestic violence is one of the most common arrest categories in California and one of the trickiest for bail. Bail amounts vary widely by county and by what specific code section was charged.
PC 273.5 — Corporal injury on a spouse/cohabitant (felony)
Los Angeles County: $50,000. Orange County: $50,000. San Diego County: $50,000. Bail bond premium at 10% = $5,000 cash to post.
PC 243(e)(1) — Domestic battery (misdemeanor)
Most counties: $20,000. Premium: $2,000.
PC 273a — Child endangerment (often charged alongside DV)
Los Angeles: $100,000 felony / $25,000 misdemeanor. Bail can stack quickly when multiple charges hit.
PC 422 — Criminal threats
Typically $50,000 when filed with a DV charge.
Bail enhancements
Prior DV convictions, presence of children, use of a weapon, or violation of a restraining order can double or triple the bail. A judge may also set 'no bail' for serious injuries.
Emergency Protective Order (EPO)
Nearly every DV arrest comes with an EPO, which bars the defendant from contacting the alleged victim or returning home for 5–7 days. This is independent of bail and must be followed regardless of release.
