Bail Bondsman vs. Public Defender: Who Does What?

Two different roles, two different jobs. Here's exactly what each one handles and how they work together.

The bondsman gets the defendant OUT of jail. The public defender (or private attorney) fights the case. Both happen in parallel.

    Bail bondsman role

Posts the surety bond. Handles the 10% premium, paperwork, jail release coordination, and bond exoneration at case end. No legal advice — they're not lawyers.

    Public defender role

Court-appointed for clients who can't afford a private attorney. Represents the defendant at every hearing, files motions (Humphrey, 1275, suppression), negotiates plea offers.

    How they overlap

A public defender can file a Humphrey motion to reduce bail — that benefits the bondsman directly because lower bail = lower premium = easier to afford.

    When you need both

Every bail bond client should also have qualified defense counsel. We refer to local defense attorneys and coordinate scheduling. Call (909) 406-6909.
